1. Introduction and Acceptance
These terms form a legal agreement between you and ServeMint. If you are accepting these terms on behalf of a restaurant or business entity, you confirm that you are authorized to bind that entity.
2. Description of Service
ServeMint provides restaurant software including QR-based ordering, customer-facing ordering flows, role-based dashboards (owner, manager, waiter, kitchen staff), operational analytics, and related services. Features may change, improve, or be retired over time.
3. User Responsibilities
You agree to provide accurate information, keep credentials secure, restrict unauthorized access, use the platform lawfully, and ensure your staff uses the service in compliance with applicable laws. You are responsible for the data entered into your restaurant account.
4. Payments and Fees
Subscription fees, onboarding charges, and applicable taxes (including GST where applicable) are payable as per your selected plan or signed order form. Monthly plans renew automatically unless canceled before the next billing cycle. Delayed payments may result in service suspension.
5. Intellectual Property
All rights, title, and interest in the ServeMint platform, software, branding, and related materials remain with ServeMint or its licensors. Except for the limited usage rights granted under these terms, no intellectual property rights are transferred to you.
6. Disclaimer of Warranties
Services are provided on an "as is" and "as available" basis, to the extent permitted by law. We do not warrant uninterrupted operation, error-free performance, or complete compatibility with all third-party systems and devices.
7. Limitation of Liability
To the maximum extent permitted by law, ServeMint is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, business, or data. Aggregate liability for direct claims is limited to fees paid by you for the service during the twelve (12) months preceding the claim.
8. Termination of Service
Either party may terminate services in line with plan terms or contractual notice periods. We may suspend or terminate access for payment default, legal non-compliance, abuse, security risk, or material breach of these terms.
9. Governing Law and Jurisdiction
These terms are governed by the laws of India. Subject to applicable dispute resolution requirements, Indian courts shall have exclusive jurisdiction.
10. Changes to Terms
We may revise these terms from time to time. Updated versions will be posted on this page with a revised "Last updated" date. Continued use after updates means acceptance of the revised terms.
